Microsoft Update:
Recent communications from CfH and Microsoft confirm that due to the demise of the Microsoft Enterprise Agreement, all NHS entities are now individually responsible for funding, purchasing and management of Microsoft licensing. This has raised serious questions pertaining to entitlement and allocation and no doubt will uncover issues around compliance, license transfers and the management of software licensing moving forward.

The key software licensing changes came into force on the 31st May 2010 and represent a real change in terms of managing Microsoft licensing on an on-going basis. Whereas previously this was managed by CfH in some areas, now the onus is on the local organisation without the support, benefits or funding of a centrally negotiated Enterprise Agreement (EA). This means that entities will be solely responsible for procuring the required licenses probably under either a Select, Select+ or individual EA moving forward.

The Upcoming Transfer:
The main question over allocation of the centrally procured licenses should be answered soon whereby Connecting for Health (CfH) will advise all entities previously covered by the EA what their licensing entitlement will be. The actual allocation for each NHS entity is being based on information that was provided to CfH earlier in the year and an updated survey and declaration that will need to be completed by all trusts before the 29th October. CfH are asking individual entities to provide details on the allocation they require, based on what is being used with supporting evidence.

All formal transfers will need to be concluded by the end of November 2010. This effectively means that all licenses currently owned by CfH are to be transferred to individual entities. Entities will be supported through the formal transfer process using an authorised Large Account Reseller (LAR) such as Civica, that is recognised under the Buying Solutions Commoditised IT Hardware and Software (CITHS) framework under LOT3 (specialist Channel Partner for Software).

Once the transfer of entitlement is complete, NHS entities and Microsoft will have complete visibility of what they are individually licensed to use (this is not the case at the moment).
